The Australian Financial Reviews understands that an unnamed company has paid $1.6 million to settle a defamation case against it over a blog post that accused it of breaching copyright laws.
The company, whose name has not been released, was named in a lawsuit by the Australian Civil Liberties Union and the Australian Law Reform Institute in 2016.
The defamation suit alleges that the company used “false, misleading and deceptive” statements in a blog posting and its website in the lead up to a media release in May 2017 that accused the company of breaching the Copyright Act.
The blog post referred to the Australian Consumer Law as a “slush fund”, but the organisation says it did not refer to a fund that would be used to pay damages to copyright holders.
The copyright holders have sought damages from the company, which was a subsidiary of the multinational pharmaceutical company Pfizer, as well as other parties.
The organisation says the company has already paid out $9.5 million to consumers and has not made any payments to individuals.
